Subject: Complaint 9/4465 concerning Crystal Palace
redevelopment
Further to my letter of 21 February 2000, I would like to inform you that the Commission has now decided to send a letter of formal notice to the UK authorities with regard to the application of Council Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment to the Crystal Palace redevelopment project.
The letter of formal notice addresses the fact that there appeared to be considerable flaws in the environmental consultant's report relied upon as the basis for the decision by the relevant competent authority not to require an environmental assessment.
Furthermore, the letter of formal notice addresses the general exclusion of so called reserved matters from the environmental assessment process even where these issues may be relevant to a decision as to whether the proposed project is likely to have significant effects on the environment both with regard to the screening of projects and the actual environmental impact assessment if it is decided that one is required.
I will keep you informed of the response we receive and of any follow up action that is taken.
